Elder Law Series–Guardianships and Conservatorships

Charles L. Dorothy will discuss what guardianships and conservatorships are, and the specific procedures and documents involved in each proceeding.

He will discuss (a) the petition, the evaluation report by health care professionals, and the statement of financial resources that must accompany the petition, (b) the no tice of hearing that must be mailed to all interested persons, (c) the evidence that must be presented at the hearing to justify a judge entering and order creating a guardianship or conservatorship, (d) the ongoing responsibilities of a guardian and conservator, and (e) the range of attorney fees that will probably be incurred in such proceedings.

He will discuss how Powers of Attorney and revocable trusts avoid guardianships and conservatorships.
